New Pilot Program Lifts Lifetime Sponsorship Ban from Certain Family Members

A new 2-year pilot program announced today is lifting the ban from sponsorship applications for a few family members who were otherwise banned from applying for Canadian PR by IRCC (Immigration and Refugee Protection Regulations).

This pilot is designed for those non-accompanying families who were not examined or even declared while applying for Canadian permanent residence. This generally results in putting such family members in question under a lifetime ban from getting sponsored. The family members in question were put under lifetime ban under paragraphs 125(1)(d) and 117(9)(d) of the regulations.

The said regulations need foreign nationals who are applying for PR to declare all the members of their family including, spouse, dependent children, common-law partner. Also, they must get examined them by an officer of immigration even if they will not accompany the primary applicant.

As per IRCC (Immigration, Refugees and Citizenship Canada), "the regulations encourage full disclosure by immigration applicants, to enhance the overall integrity of Family Class immigration, and to protect the health, safety and security of Canadians.”

As per Canada’s Minister of Immigration, Refugees and Citizenship, Ahmed Hussen, "Noting concerns for the “disproportionate impact” of this lifetime ban on certain individuals, especially children."

Those “most vulnerable populations” who is suffering from the ban must meet the following requirements:

  • The foreign national must apply as a spouse or common-law partner
  • The foreign national must have a sponsor who:
  • Has applied for and is a permanent resident of Canada as a Convention refugee
  • Was granted PR status after being deemed a protected person
  • Was determined as a Family Class member and ha a permanent residence status of a sponsored spouse, conjugal partner, dependent child or common-law partner
  • Was determined as a Spouse or Common-Law Partner in Canada Class and has a permanent residence status of a sponsored common-law partner or spouse

According to IRCC, this new two-year pilot is not applicable if the sponsor has a permanent residence status under Canada’s Economic Class or other immigration streams that are not specifically falling under the above-said conditions.
